Standard Terms and Conditions

General

1. When using the services and products of The Floor Plans Company (whether instructing us by phone, e-mail, letter, on-line or verbally) you agree to be legally bound by the following terms and conditions.

2. The Floor Plans Company reserves the right to amend these terms from time to time and will post the current version on its site at www.thefloorplanscompany.com

Prices and Payment

4. The Floor Plans Company reserves the right to amend it prices from time to time.

5. Payment of all invoices is due within 10 working days of date of invoice or prepayment if non corporate.

6. The Floor Plans Company reserves the right to submit invoices by e-mail or post.

7. Payment of outstanding balances is due within 10 working days of invoice.

8. The Floor Plans Company reserves the right to charge interest at 4% above the Bank of Scotland base rate on all balances outstanding beyond 10 working days and to include reasonable costs of collecting overdue monies on outstanding balances.

9. All invoices are subject to VAT where applicable.

10. The Floor Plans Company will charge £0.50 per mile for appointments over a 50 mile distance from our offices in Ayr, this will cover travelling time and fuel cost. However this can be waived depending on the contract.

The Floor Plans Company

11. All the plans that are supplied are intended to be for indicative purposes only. They are drawn in compliance with RICS and PMA guidelines (where stated on the specific floor plan) but it remains your responsibility to ensure that the plan is accurate representation of the property.

12. Where the floor plans are produced from clients sketches (Sketch and Fax) or re-drawn from other representations of the property, no responsibility will be tacken for the accuracy of the floor plans or any areas calculated from them.

13. The Floor Plans Company will use it's best endeavours to make available the floor plan within 48 hours of visiting your property.

Your Obligation to Us

14. You will be liable for the full cost of the services or products ordered and for payment within the agreed terms.

15. You will be responsible for providing access to the property involved at the time agreed and ensuring that the property is accessible.

16. You warrant that you have authority to commission floor plans or related services in relation to the property in question including allowing representatives of The Floor Plans Company access to the property.

17. In event of cancellation you will be responsible for the costs as detailed in this agreement.

Warranties and Liabilities

18. The Floor Plans Company warrants that it will use all reasonable care in providing the services detailed in the terms and conditions.

19. All other warranties expressed or implied are hereby excluded to the fullest extent permitted by law.

20. Any liability that The Floor Plans Company may have (whether in contact, tort, including negligence or otherwise) shall be limited to the total cost of the services paid by you under this agreement.

Intellectual Property

21. All copyright and other intellectual property rights in relating to the services shall be owned exclusiveley by The Floor Plans Company.

22. This is the only agreement between The Floor Plans Company and you. If the court decides that any part of this agreement will continue to apply.

Notice

23. Any notice given under this agreement must be made in writing and sent by pre-paid first class post to the parties respective address. The Floor Plans Company address is Chestnut Cottage, Raithill Farm, Sundrum, Ayrshire. KA6 5LB.

Applicable Law

24. This agreement shall be governed by Scottish Law in Scottish courts.

Cancellation Policy

25. It is our policy to accept cancellations for services up to 5:30pm on the day before an appointment without charge. However we reserve the right where cancellations are received after 5:30pm on the day before an appointment to make a charge no greater than 50% of the original job charge.
